  • Advance Parole for GC

My mom is here in the US on a tourist visa and we have applied for her GreenCard.

Her fingerprinting is scheduled this week. She has applied for Advance Parole and the receipt for that says it will take 60-90 days.

Due to medical reasons(a surgery she has to undergo), she will have to leave the country in november.

    1) Does she require the advance parole when she leaves the country or is it required only when she needs to return?

    2) What are the risks of leaving the country without the advance parole being approved? She has her I-485 receipt and she would have got her finger printing done by the time she leaves?

    Please help. Thanks

1.- She needs to have the Advance Parole approved BEFORE she leaves the USA. She does not need to have it to leave, but it must have been approved before she left and have it in hand when she returns.
2.- Her application for Adjustment of Status (i-485) will be considered abandoned and it will be denied. As soon as she leaves without the AP being approved. Regardless of whether she has the Biometrics done, or whatever receipts, she needs to leave AFTER the AP has been approved.
