    Hello,

I wanted to inquire about my temporary green card. My 2 year period of temporary green card will be done in January 2008 and I need to file for a permanent green card in Novemeber 2007.

I received this card through marriage and unfortunately me and my spouse will be filing for divorce in august. The marriage was entered in good faith and we have documents that support the fact. I was wondering if you can help me with this situation. My husband is willing to sign the green card paper but we will be checking the divorce box in the 1-751 form.

Will I be able to receive my permanent green card even though we will be filing for divorce?

Please let me know how I can go about this legally.

    Thank you,

You would not be able to get permanent green card in this case. Unless you can provide enough evidence that the marriage was entered in good faith, thus obtaining a waiver for joint-filing of removal of conditions.
