  • Question for PraetorianXI

    Hi,

I have received good advise from you in the past, so here I go with 2 other questions.

I came to the US with a F1 visa in 2002, did my program, and got my H1B in 2003. I applied for my green card in 2004 and have gone through this process since then. At this point, I have everything approved: Labour certification,I-140,EAD(I received it last week). I'm only waiting for my AOS I-485 to be approved. I got married on October 9th with an american citizen and it gave another perspective in my process. These are my questions:

    1. Should I complete the I-130 in order to speed up my green card process. Would that really speed up my process at this point? The processing times for AOS through employment is December 2006 and mine was received in June 2007. With the whole thing about the Visa bulletin that doesn't seem to move from AUG 2002, I don't really know.

    2. In terms of looking into a future naturalization. What would count? My GC through employment or the fact that I'm married to a US citizen? I know that with the last one, I could apply for my citizenship sooner.

I hope I was clear with my questions and would appreciate your views.

    Best regards,

it depends totally on your PD.

It looks like that you might be better off filing another I-130 and wait for its approval. Usually GC through spouse can work pretty fast and as you pointed out would make you eligible for Citizenship sooner.

Have patience. Just friendly notes keep the current processing status. Your family based GC process may not speed up due to current back log. Rest is up to you, if you want to apply citizenship sooner?
Basic difference is you will get 10-years GC based on employer but only 2-years CONDITIONAL GC based on family sponsorship.
Whichever method you get GC that you have to mention in future naturalization.
