Travel out side USA with Travel document whileH1 ,I-94 expired,applied for extension

HI,

I have a very confusing sistuation. I am on H1-b Visa which expired in octover 10th 2007. I am married to a usa citizen and applied for family based green card. Did not apply for EAD since i was on H1-B at the time of applying .Any how i have applied for Travel document. I recently got Finger prints done and i have the travel document. My employer has applied for my
H1-B visa extension in september 2007.I do not have the receipt number yet.I have a family emergency and i need to travel out side usa in couple of days.Can i use my Travel document for that and can i come back into usa?? My I-94 is expired too and my H1-B visa is expired and applied for extension.Please help since the sistuation is concerend with death of a family member and i need to travel very soon in a day. I do not know what to do.Any help is greatly apperciated. Thanks in advance for any help

Yes, you can use your travel document (advance parole) to travel and re-enter the US. You can also continue working with your current employer as soon as you get the H-1B extension receipt.

I have quick question again, Since my I-94 is expired do i have to surrender during the port of entry?? will i get a new I-94 or i do not have to worry since it is already expired and waiting for my H1- Renewal??
