  • Question for Praetorian,

    HI Praetorian,

Once again Thanks for your help. I have one more question, I have gone out side of usa and reentred safely. At the port of entry the officer told me i can only have either H1 or AP and if on AP can not work, checked with some other people and came and told me that its a happy news that H1's are exempt and they can continue working and took my I-94 and gave a new I-94 putting AS( Adjustment of status) and put working for " employer company name". He suggested to apply for EAD so there will be no other complications.

So i think i can continue working again with out any problem sicence he has said it?? and allowed me to enter US although my H1 is not yet approved and since my employer has applied my H1 with in the expiry date??
I was searching other forums and they say you can not work i am really confused. Please help me so that i willl not jepordise my sistuation, should i have to give my new I-94 details to my employer ?? I am conserend if my employer may cause any problems.

    Thanks in Advance
    Raj

You can work with you current employer with the receipt for your H1 extension.

Or you can file for EAD and work for anyone (including your current employer).

I recommend you apply for EAD and in the meantime, continue working for your current employer.

        It depends on your employer.
