  • I130 Vs I484 Please help!

    A little background.
    Husband came over on a valid visitor’s visa. I was pregnant with his child at the time. We got married while he was here. We had our son. I work he doesn't. We got a lawyer to fill out the paper work and submit it for us. I130, I485 and I765. When we submitted the lawyer said I made enough to sponsor him in. We got a letter back stating I didn't, so we got my best friend to be a joint sponsor for us. Then comes the Email "we mailed your decision” so we wait and wait and wait. Nothing. He calls INS to find out I485 was denied. They wouldn't give a reason over the phone and said wait tell it come in the mail. Same response from the lawyer. Now we are so nervous we can't sleep and still waiting.

    My question is if the I485 was denied does that mean the I130 was as well?
    If the I130 was not denied as well does that mean he can get SS # once we get the visa number?
    I have read several things on this I130 one place says it has no expiration and another says you have 180 day's to file the I485, which is it.
    What exactly does the I130 do for us? And doesn’t do for us?

    If the I-485 was denied (without an interview?!) it does not really matter whether the I-130 was approved or not (not very much anyways).

    He is out of status and he can not apply for anything. You will need to file a motion to re-open the case and produce evidence.

    This makes no sense. Why was the application denied? that is the first question you need to ask USCIS.

    Go to your local DO through an infopass appointment and find out. And get your lawyer to work...

      Yes with out a interview. they say we have to wait for the mail to find out the reason. its been 12 days since we got the email and nothing has showed up in the mail yet. What is a DO and an infopass appointment? We never heard anyting about the I-130 or the interview or the I-765 forms only thing we every got was on the I-485 that he needed a co sponser. O' we went to get the biometerics as well. that was before we got the letter obout the needing a co sponser.

        DO = District Office. Your local USCIS office.

        Infopass = Appointment to go and speak with an immgration officer at your DO (infopass.uscis.gov)

        You SERIOUSLY need to get your lawyer to work and figure out what is going on. Your husband is in a deep situation if you two do not act fast.
