Travel with Advance Parole

Hi,

We had applied for my mom's greencard(I-130, I-485) in August. She has completed her fingerprinting and also received the approved Advance parole document. The only thing pending is her GC interview.

She needs to travel back to our home country to get a surgery done(health reasons) in November end. She will need to rest and will be able to return mid February.

When we called INS, we were told that if her interview call comes when she is outside the country, she can postpone it once provided the reason is genuine(medical) and a fixed return date is specified.

Just wanted to clarify that the above is true and there will be no other complications? She would be re-entering the country using her Advance Parole in Febraury.

It is true. She can reschedule her interview and travel on AP if she HAS NEVER OVERSTAYED MORE THAN 180 Days.

Otherwise she will be banned from 3-10 years from returning to the USA.

She has never overstayed.

She is currently here on Visitor visa for 6 months which expired on October 18th. But she would be leaving on November 18th as we had to wait for the advance parole to get approved. We obviously got the receipt of I-485 before October 18th.
