  • Big question for Green card

    Hi guys, I hope somebody has a answer of my question.
    Here is my question. I am a U S citizen and I filed a petition for my mom for Green card, She got her Green Card, she came here and stay here for 11 months and went back to my home country, I got a reentry permit for her for 2 years, now her time is due to come back, but she is not ready to come back. So I am planning to surrender her Green card and apply for visitor vise. So here is the question, if she get a visitor visa and suppose after 5 years circulstance change and she have to come here permanentely, than IT IS POSSIBLE THAT I CAN FILE FOR HER GREEN CARD ONE MORE TIME ?Please advice. Any help is appriciated.

    I know people who've done this and USCIS has no problems in granting the permanent residency once again.

      It is possible. She may face tougher questioning or she may not, but it is possible.

          My father surrendered his green card and asked for visitor visa and they denied it. So I had to file petition for immigrant visa and then it went into administrative process 221g that why he left and didn't come back. It took 16 months to clear + security clearance blah blah.
          From my experience I suggest you not to do that. Just ask her to visit you for a while and then go back. It is getting very tough and going to be tougher in future.

            She can not live in her home country and yet keep her GC by just visiting the USA.

            Either live in the US or surrender the GC. Otherwise she will be stopped at POE one day, questioned harshly about whether she is really and resident and demanded proof and who knows what.

              Emotional/Social issue

              Guys, many a time it's more of an emotional/social issue than the logistics.

              Most parents prefer to live in their home country for obvious reasons.

              Sure, there's always a possibility of the visitor visa getting denied in future, but it's only a possibility.

              Most of the times, it's not an easy task for the parents to travel back and forth between US and home country just to maintain the GC. Unless they're prepared to live here for five year, get their US citizenship and then decide upon the final country to live, it's better to surrender the GC and get a visitor visa when required.

              PraetorianXI is absolutely correct, that you cannot live in the home country and yet retain the GC just by visiting US. It may and will work for once or twice or maybe even thrice, but after that there will be more and more questions asked at POE. Also, remember this will put a heavy toll on the parents too and they may just get tired of flying back and forth every time.


              Most people do easily get the visitor visa, of course sometimes there are issues.

              However, at that time, I can tell you for sure that the parents would still be happier that they're in their own home country and would not really be that dejected if the visitor visa is denied.

              Sure, the kids will not be pleased.
