  • I-864 and same source of income doubt

    Hi,
I just filed the I-130/I-485 package for my spouse.

I am the sole sponsor for my spouses affidavit of support. If I quit my job or there is a lapse between jobs or if I am unemployed at the time of the interview, is the application in jeopardy?

Can we include my spouses income, now at this stage since we have a receipt niumber for the I-485. We didn't include it before because there was a clause which seemed very strict.: "Income from the intending immigrant, if that income willcontinue from the same source after immigration, and if theintending immigrant is currently living in your residence. Ifthe intending immigrant is your spouse, his or her incomecan be counted regardless of current residence, but it mustcontinue from the same source after he or she becomes alawful permanent resident."

The issue we had was what about if my spouse changes employers in future (even if its binding for a couple of years), the source of income will change. So it seems wierd to restrict applicants even after they get the greencard.

But i guess we will have to include the income as well if it comes to that.

    She can add her income.

If you change jobs, you will need to provide a new employment letter and paystubs and if you become unemployed, you will need to provide with another I-864 filed by someone else who will co-sponsor her.
