Marrying bf but he is still applying for divorce

My H1 visa is expiring next month and labor certification was filed in Jul 07 so decided to marry US citizen bf of 2 years but he has not yet filed for divorce after 5 years of separation from wife. Waiting time is 90 days so I will be out of status for about 2 months. Will I be deported?

You could or could not be deported. We can not tell you that. it is up to ICE.
