  • Form Needed to Apply Greencard for Parents

I am preparing for the greencard for my parents.

    1. Do I have to file I-131 for them if they are not planning to leave US before the greencard is approved?

    2. Do I have to file I-765 for them if they are not planing to work here?

    Thanks

    Ling

No, you do not need to.

However, the fee for these forms are included in the $1,010 for the I-485. So, it would not cost you anything to apply and it would be a good thing to have, just in case.

Thank you very much for your reply.

One of my friend is thinking to apply for green card for her parents as well. But they will be over-stay for almost 3 years before she can apply for them. She will get her citizenship next month. Can she still apply for them? Will it take longer than usual for them to get the green card?

She can apply for them as soon as she has her naturalization certificate... why are they overstaying 3 years? that is not advisable.

Thanks for taking time to answer to my question.

Do I have to have police clearnance for my parents when I file both I-130 and I-485 for them? They are currently in USA on B1 visa.

No. They are not available either.
