  • Please Help Me!!!!

    Hi everybody
I am new to this forum...so i was hoping somebody could answer my question.
My mom recently received her greencard and I was wondering if she could help me to get a green card too. While she was waiting for the gc i aged out. Now I am turning 23 and my visa is about to expire too. I read a little bit about the Child Status Protection Act, however, I don't know exactly what to do. Its hard because I have been living in the states for 5 years now and my parents are my primary financial caregivers. Please let me know my options. I applied for a student visa aswell but that is taking sooooo long too. Also applied for the DV-lottery in hope to get the gc somehow. I am really heart broken because I am in the middle of my medical school...pls help...Thank you

Under what category did your mother receive a GC? employment? family based? sponsored by whom?

Under what status and visa are you living in the USA? You applied for a student visa, but it is taking long but you are in the middle of Medical school? (makes no sense, how can you be studying without a visa)?

Either way, your mom can only sponsor your for a GC when she becomes a US citizen, which will take at least 5 years, and then file for you and you must wait until your Priority Date becomes current, and you will have to wait several years for that to happen.

Sorry for not explaining my case properly...I am in a foreign medical school, however, I live at the border of mex and us....The school is close enough at the border that I can still live in the states and travel to school accross the country everyday (sounds bad but its really not). Besides that my mom got her gc through employment. I thought i could apply for I 130 (it said - parents with gc can apply for I 130 if son or daughter is unmarried and over the age of 21) but of course there is a longer waiting list. I am confused of what i should do. The best bet is to wait till my student visa gets approved (which i sent in on nov 1st). Also at the border they have the green form that allows people to stay in the states for 90 days. I could use that but someone told me that after receiving that entry form I will have a hard time applying for any visas. Is that true????

Are illegally crossing the border everyday? What visa status are you in the US with?

Your mom can file for you, but the waiting time is LONG.

Your Family Based immigration category is F2B, and they are processing applications from Oct 15 1998. Meaning, it will be 10-12 years before you can get a GC through your mom in this category.
