  • Receipt Issue with stand alone I130's

    hi,

I sent in seperate I130 petitions for my parents on Nov 19th 2007 and the mail packet was delivered on Nov 21st. I didn't receive the receipts from USCIS yet and neither did they cash the checks. I understand that it is taking longer for USCIS to process I130 and they are giving priority to N-400 and I130/I485 application first per their website.

Question is how long should I wait before calling them ?

I also read another notice on USCIS website to file stand alone I130's at the chicago lock box effective from December 3rd. I am worried if my application which was sent on Nov 19th will be processed or not.

They received it in time. It has not been processed yet, but they got it. So since it is postmarked from Nov, it should be fine.

Wait 60 days before calling them. Even then, there may not be much they can do for you without the receipt (which is the problem).

        Thanks

        Thanks PraetorianXI,

I am really disappointed that USCIS didn't anticipate a surge in application as it was alwaz on the cards since they increased the fees. Not only me but for all the people whose cases would have otherwise been processed in time.

        1) How important is the receipt ? Can they not send the receipt and directly mail the case approval letter ?
        2) Is it correct that the longer it takes them to send the receipt the longer it will take them to process a case ?
        3) How long do you think a typical standalone I130 processing should take in current situation ?

            Sorry

I feel very sorry for you shazizub, it is frustating situation to be in. I am surprised why they didn't send a receipt for you application even after 3 months. I am wondering how long will I have to wait as I just filed seperate I130's for my parents in November. I do not want to believe that the reason for delay is surge in the applications. They should've anticipated it especially after raising the fees in June-July(or whenever) this year and should have taken necessary steps.

Luckily, I applied for my citizenship earlier this year in May and the whole process took 7 months. I am glad that I was eligible to file early this year otherwise the current N400 applications time frame is 16-18 months which is too lengthy. Looks like delay will go well into late 2008.

Can anybody guess what will be the approximate time frame for standalone I130's to be processed ?

1.- It is important, but for your own records. I do not know how they process and mail it, so IDK.
              2.- Not necessarily.
3.- It could take 4-12 months.
