  • GC based on marriage to US citizen

My husband is a US citizen and we were married in November 2006. I was on H-1 status that expired oct 1, 2007. I immediately got pregnant after we were married and did not send in the papers (I-485, I-130, I-765 and G325A) to file until end of August to the Nebraska office. The paperwork got sent back to us with a letter from USCIS that we needed to send it to an address in Chicago. We sent it via UPS, and UPS contacted us that the address USCIS gave us was an OLD address. We called USCIS immediately and got the right address, finally delivered and received on September 17, 2007. The company I worked at would've renew my h-1B if I would pay for the fees myself. At the time, I refused because we did not have the funds. My husband is not working and I was the primary caregiver in our household. Our son was born on September 30th 2007, and we are still waiting for my EAD to get approved. I tried to contact USCIS for any info to expedite my EAD for an emergency situation (unable to pay rent, provide health care for my newborn, etc) and the agent I spoke to sort of laughed at me, saying this is not an emergency situation. We didn't want to have to go through government assistance at first, but we are desperate. Unfortunately we can't get any public assistance for our situation, not even unemployment benefits because my situation does not apply. We are also having a hard time trying to get Medicaid/Medicare for our newborn, on top of having to pay the bills from the hospital for my labor/delivery. Unfortunately my insurance ran out the day he was born (according to my expired H-1B status). Maybe I don't know the system enough to go to the right places. Can anyone help?

Thanks in advance for your advice
