  • Married to citizen, currently on H1B with valid I94

    To whomever it may concern,
First of all thank you for huge help thru this site. Can anyone please help me in explaining the exact process/sequence for filing my green card, EAD, Advance parole, change of status.

Scenario: I came to US on L1B visa in Feb 2006. And I switched H1B after Oct 2007 when i got approval from new employer,, but haven’t gone out of US for H1B visa stamping yet..
Recently got married to US Citizen in Dec 2007 – only registered court marriage in front of Justice of Piece..My Husband is working. I want to file my green card ASAP and would like to switch to EAD workpermit once I get it , so I can work independently.. Seeing the forum info I found it takes 3 months to get EAD. Also want to go to India in March / April for a month such that I can avoid H1B visa stamping.
Can anyone answer following questions for me? Thanks in advance for your help!!!
    1) Do we need to file all forms simultaneously? My husband will file I-130 for me, and also we need to submit G-325A for both.. Does he have to file I864 also?
    2) Is I485- mandatory for ppl in US?? And when I have to appear for interview/ fingerprints.
    3) Do I have to file I485 – adjustment of status, I-131 –advance parole, I765-Employement Authorization – by looking into my scenario and when should that be?
    3) I am currently working based on my h1b approval and i94.. Can I still continue working with my H1B until I get EAD (on family based greencard) and I-485 OR once I file those application, H1 is automatically invalid.
    4) I assume it takes 2-3 months to get advance parole, can I just visit thru in and come back with any h1b stamping and continue working on h1b until I get my EAD. pls suggest me some option so that i can avoid stamping when I visite- while my file is process.
    5) I think we have to file I-130, G-325A, I-485, I-131, I-765 .. am I missing any form submission?
