  • URGENT - Need infertily treatment while I-130 pending

    Hi,

    My husband is a permenant resident and had fill in january 2005 I-130 for my daugther and me. The petition is still pending. I' am 38 years old and I need infertility treatment in the USA where my husband live to get pregnant. I have a tourist visa but i want to ask for a V visa for my daugther and me. could I apply for this visa? if not was can i do regarding my stay in the USA to have my infertily treatment. My husband hadn't a child so it realy important to or couple to have a baby. I can't wait for my immigrant visa because it will take long and i'm getting older.
    I'm actualy in the USA with my daugther, i already start my treatment but my tourist stay will expired in february 2008

    PS: sorry for my bad english. I'm a french speaker.

    Sorry, but you can not stay in the USA for that, if you try extending your visa it will likely be denied and you must return home before applying for a V visa.

    You need to get the treatment done either in Canada or France or other country.

      I’m realizing that I’m in a difficult situation because I need to be close to my husband during my infertility treatment. I have injection every month for ovulation stimulation. And my husband is working in the USA; he can’t take 4 or 5 months for a treatment in Canada our France where I'm resident.

        Then it will be very hard. You guys will have to wait or... errr freeze the stuff and take it with you for in-vitro?

        Either way, medical visas are hard to get and they must be critical medical conditions... and you can not be on a visitor visa for longer than 6 months.

          Thanks again PraetorianXI ,

          yep, yep !in vitro may be the last solutions for us because very, very expensive. We was hoping to tray the stimulation apportunity before. Sometime immigration system is not fair with honest people.
          And for the V visa i 'll be eligible in january 2009 because my I-130 date is january 2006 ( 2005 was a mistake)
