I have an immigration based question. I would really appreciate it if you advise me on this situation.
When I was young like 7 or 8 yrs old, I was adopted by my aunt and uncle who live in Canada. But right after the adoption they had their own daughter so they never took me with them to Canada nor paid any expenses on my behalf for my care. They have always been in Canada and I stayed in India..Since my birth and until I moved to united states, I lived with my biological parents and they bore all my expenses for my upbringing and school/college.
I have been in the United States for the last three years. I came on a marriage base,,,I married a US citizen. And now l would like to petition my biological parents. My birth certificate has my biological parents name on it. However my Indian passport shows the adoptive parents name since my passport was processed right after the adoption. And all the immigration forms when I first came to states, I had to use adoptive parents name since that’s what my passport showed
I have gotten an affidavit from my aunt and uncle stating they never had anything to do with me and that they don’t have any rights over me.
The question, since now I have become a US citizen, can I petition my biological parents based on my birth certificate? If needed, I do have the affidavit from my aunt and uncle. Can you please advise me what I should do in this matter?
I want to make sure everything before I apply for them because I don’t want any type of interruption in the petition.
