Hi,
My partner and I have been together almost two years now – we met while I was studying on a course in the US (I’m actually from the UK) and carried on our relationship over long distance for about a year.
Since June 2006 I have been coming over on a regular basis on tourist visas and study visas but we really just want to be together now as the cost of coming in and out of the country every 90 days is huge.
We have decided to get married asap, and have obtained a marriage licence in the state of NY. Can we just get married and apply with a I-130 after the fact even though I am here on a tourist visa – or should I apply for a fiancé visa – and if I do that I can I do it whilst I am here in the United States.
I hope you can help, I feel like I’m going round and round in circles.
