  • Query Re I-131

I am filling out all necessary forms after marrying my fiance. I have a question regarding the I-131. I intend on traveling back to Ireland at some point this yr for a vacation but unsure when yet. In the form (Part 3) it asks "Date of Intended Departure". Is it compulsory to have exact dates? I'm guessing it will be Christmas time but afraid to put in approx. dates should they change and cause problems later.

Your help in this matter is greatly appreciated!

Just put a date... now, applying for an Advance Parole with 10 months before the expected trip is NOT a good idea, as your AP will only be valid for 1 year and by Christmas it may only have a few months left on it...

Still, you never know what emergency may arise... so go ahead and apply, and put some date in the next 3-4 months.

You have not overstayed your visa right?

Thanks again Praetorian! No I am still within my VWP exit date (19th March). I just wasn't too sure if the I-131 was a form I should maybe apply for at a later stage once I get my GC. Thanks for the advice. I will pick some dates within the next 3-4 months instead.

Once you get your GC, you will not need an AP... or an EAD. You are free to travel and work with just your GC.

The only reason to file for I-131 AFTER you get the GC is in the event you plan to stay more than 6 months, less than 1 year outside of the USA.

Does this mean I need not send in an I-131 then with the rest of the GC paperwork?

You do not have too, but it is free. The fee is included with the I-485 fee. So either file for it now, or later.

                Question about I-130

When you fill I-130 for the married sons and daugheters. you fill out one form for th married son, then fill the spouce and the childrens names in the I-130. there no need to fill out a seprate I-130 form for the spouce and the children, so one form is for the whole one family. is that correct ?. I just want to be sure on this. Thank you

Hello34 - My query here was regarding the I-131 form. I wouldn't have the answer for you either on that about the I-130. I'm only filing for myself

I suggest that you start a new thread so that PraetorianXI or Immihelp can see your question because with my query answered they may not come into this thread again.

                  Best of luck!
