  • Please Help!! Terribly confused!

    Hi,

    My situation is the following:

I've been dating my now wife for about 1 year and a half. I currently live in Mexico and she lives in the US. She is an American citizen. We decided to marry a couple of months ago in the US. We now have our marriage certificate.

We normally see each other 2 or 3 times per month, we travel all the time and when I visit her I use my tourist visa to enter the US.

We have plans to finally move in together this 2008 (the earlier, the better). We have just finished filing all of the forms we think we need in order for me to get a legal resident status and be able to look for a job.

I've been researching around the Internet and all of the scenarios I have come upon are based on a Fiance visa application, which is no longer a feasible solution for me, given the fact that we are already married in the US.

What path should I follow in order to get my legal resident and EAD permission? If you could help me in providing a time frame (ie: First file I-130, after Notice of action file ...., etc.) it would be of great help.

Finally, my other concern, the I-693 Medical Examination form. Is it mandatory that I perform the medical analysis in the US? or is there a way of me having them here in Mexico with a certified doctor?

Thanks! I will appreciate your responses!!

    PS. I have files I-130, I-485, I-765. G325a for both of us.

You need a K-3 spousal visa instead, read all about it here: http://immihelp.comhttps://www.immih...n-process.html

      Thanks for the prompt response!

The visa that I currently have is standard tourist visa / border crossing card that you can obtain in Mexico.

I will keep travelling back and forth with this tourist visa in the upcoming months to see my wife, as it is the only way I can enter the US.

What I understand from the K3 visa is that my wife needs to file the I-130 while I'm here in Mexico, but I may also be in the US visiting while we wait for the Notice of Action from USCIS.

How do I receive my K3 visa? And can I travel back and forth with it? Or do I have to move permanently to the US to complete the process?

Also, If you have information about the I-693 Medical Examination and performing it in Mexico I would appreciate it.

      Thanks again!
