  • Any advise on this Murphy's law INS case

    Well, here is my situation:

I was approved my I-140, given my EAD card, taken my biometrics, and medical exams back in may 2007. At that time, I (well, my lawyer) submitted my I-485 to Nebraska. With all the retrogration issues that happened last year, I saw myself waiting for 2 more years before my adjust of status could be approved and a visa could be available to me. Then, I decided to marry my boyfriend (US citizen). We filed the I-120 in VT, and already got a receipt. However, today I find out that my priority date is finally here. According to the Visa bulletin, they are in Jan 2005 for 3rd category workers. My priority date is October 2004. With everything approved, at this point, my GC would finally be ready. However, my lawyer made a transfer to Family based greencard back in November. That was the most logical thing to do.

Here's the thing: I keep checking my INS portfolio online, and it doesn't look like the INS has already done the transfer. I'm not sure if that's the case, but wouldn't it be nice if I could get my GC through employment now that the dates are finally current? Does any of you know of a situation like this? I would appreciate your advise and views on this.
