  • Need Some Major Assistance!!!!

    I am a US citizen married to a man from Mexico. He has his legal permanent resident card and has for over 12 years. Here comes the problem. While his brother was here illegally, his wife in Mexico abandoned their 4 children in the middle of the night. About a month later, we obtained the two youngest children ages then 14 and 8. That was almost 3 years ago in May. We want to be able to get them some type of papers so they can travel with us back and forth to Mexico when we go once per year. About a year ago, the mother showed back up, and went to another state here with the father. They are since seperated again. They have given us a notorized statement of temporary custody. They are both willing to give us full legal custody, and allow us to adopt the children. I have been through the INS site so much, my eyes are about to fall out, but cant figure out what paperwork I could do to help us. Sorry this is so long, but any help any one can give would be great. Thank You.

    does anyone have any suggestions at all? It seems as though the 2 year "legal" custody thing has us and the fact they are already in US illegally. Please any help?????

      I am on H1B vise expiring on 10,2009, married to a green card holder with a 12 month old first baby. my spouse have filed I-130 for me a week before.i want to know, after having I-130 approved in 4-6 months, would i be able to submit I-485 right away based on the approval receipt or woul dhave to wait for the priority date to become current, if so, then it will take at least 3-4 years and i would be out of status at that time,how can i stay legally untill th etime for 485 filing,cant leave the country without husband with the kid on my own,what options do i have with this situation.

      I would be very grateful if someone please answer my concerns.

        You have to wait till the priority no. becomes current before you can file
        485 which means a wait of few years.

        Options;

        *ANother H-1 may be the only option or an H-1 extension.

        *Change of status to student could have been possible, but an already filed
        I-130 may create problems with granting student status which requires non-immigrant intent.

        *How long for your husband to become a US citizen? IF he becomes a US citizen soon, your I-130 will be upgraged for faster approval.

          This is a very complicated case. I must assume that everyone but your husband, entered the USA illegally. Which makes things a lot harder. You need to consult a lawyer.
