    I whould like to thank for this amazing and very helpful site.

    I am green card holder.my husband has been filed on GC. actually i want to stay in india with him when he is in proccessing system. Is it ok i mean want to stay there more than in usa.my question are.........

    1 I stay in india with reentry permit?

    2 I cant work for some family reason ,so will it affect on him?

    3 Do i need to show them 3 years tax return in interview?

    4 Can i show myself self employ in order to pay tax?

    What is your husband GC based on? employment? or marriage to you?

    1.- Only for up to 2 years, no more... but you will break your continuous residency for naturalization purposes.

    2.- That depends if you are his sponsor or not... but also, you can not take up employment in India, that would make you lose your GC.

    3.- That depends, are you sponsoring his GC? Then, Yes. You need to file taxes even if you are currently abroad.

    4.- Yes.

    If you are sponsoring him for a GC, it would be best if you become a citizen first, that would make him get his GC within 1 year... if you leave for India for more than 6 months, you will reset your naturalization clock and will not be able to apply for citizenship until 5 years have passed.

      its is family based green card...i get my green card because of my father as he is citizenship holder.now i became married..so i want my husband here but i cant leave him there for too long i mean if i apply citizenship first than it will take time and i will not able to saty with him as well. but if i file him on gc may this way i can stay with him more. i think both will take same time 5 to 6 years whether i file for citizenship or file for him on GC because i got my greencard last year in november 2007(if i file for citizensip than it will take 7 year for whole process and if i file him on gc than it will take 5 to 6 year for whole process). what is your suggestion? i need your advice to make any decision.

        It is up to you... just make sure you don't lose your resident status. By maintaining residency if you plan on moving to India for a year or so.
