  • Questions about filing I-130 & I-485 pleeease?

    Hello everyone,

I am originally from the Czech Republic and recently got married to US citizen. I got to United Stated about 4 years ago on visitor visa and overstayed. I'm working on filling my paperwork so I can submit it to USCIS and I have few questions if anyone would be willing to help?

If I got this right, I'm filing for:
    I-130
    I-485
    I-765

    My questions are:
    - is there any point in applying for travel document since I overstayed my visa, I wouldn't be allowed to leave the US before I get my green card anyways?

    - do I need a Supplement A to form I-485 if I overstayed but entered US legally? Have my passport, visa and my I-94.

    - do I need to fill out the Affidavit of support? My husband is in Navy so there would be no problem but do I need it? If for the time being in USA, if I were to work illegally, should I mentioned that in the paperwork and if yes, should I put self-employed there?

    - what do I do with the biometric fees? Just pay for it with other fees and then wait for them to get me to do the fingerprinting?

    - my husband was born in Thailand to an American citizen - the form is asking him to prove that he is US citizen - can that prove be his US passport? He never got any naturalization certificate or anything like that even though he was not born in the USA.

    - my Czech birth certificate has a different last name on it that I use. My mother got remarried and changed my last name when I was little. Next to my birth certificate, I also have a paper which states the legal name change. Do I need to have that translate also and will that make me any problems?

    - also I wanted to change my last name to my husband's name but it would be so confusing for USCIS since my passport and all the documents needed are in my last name. When is the best time to change the name?

    - and one last question. When I'm done with all the paperwork, do I go to our local USCIS with the papers or do I mail them?

Thank you so much for any help I would appreciate it if someone can take time to answer the questions. And as I go through the process, I'll inform everybody here so I can be also help to somebody.

And hi to everyone. Great website. Lots and lots of help. Thanks to all the people that make an effort to keep this so great.

      Hello fellow military spouse

I am not sure about applying for travel documents since you could be barred for the overstay, so it's not recommended.

Do not know about the Supplement A to 485

Yes you will need to fill out an Affidavit of Support, and if you have worked illegally do not lie. As I understand overstay and work are forgiven for immediate family members, and you'd qualify for that. If you were self-employed say so, if not then mention that you were working for someone else...but above all else be truthful.

Yes you will have to pay for the biometrics and they will send a notice for your appointment to a local office.

A copy of his passport should suffice for now, if they need any further proof they may send an RFE (Request for Evidence) and they'll mention what they're looking for.

I think a translated form should be fine, although I did not have to go through that so that's just my opinion.

I am not sure about name change, and don't want to lead you the wrong way so someone else could probably assist you better with that question.

About hand-delivering or mailing, I believe you HAVE to mail it. The address is noted on the forms/instructions so make sure you follow those directions.
