I am originally from the Czech Republic and recently got married to US citizen. I got to United Stated about 4 years ago on visitor visa and overstayed. I'm working on filling my paperwork so I can submit it to USCIS and I have few questions if anyone would be willing to help?![Smile](https://www.immihelp.com/forum/core/images/smilies/smile.png)
If I got this right, I'm filing for:
I-130
I-485
I-765
My questions are:
- is there any point in applying for travel document since I overstayed my visa, I wouldn't be allowed to leave the US before I get my green card anyways?
- do I need a Supplement A to form I-485 if I overstayed but entered US legally? Have my passport, visa and my I-94.
- do I need to fill out the Affidavit of support? My husband is in Navy so there would be no problem but do I need it? If for the time being in USA, if I were to work illegally, should I mentioned that in the paperwork and if yes, should I put self-employed there?
- what do I do with the biometric fees? Just pay for it with other fees and then wait for them to get me to do the fingerprinting?
- my husband was born in Thailand to an American citizen - the form is asking him to prove that he is US citizen - can that prove be his US passport? He never got any naturalization certificate or anything like that even though he was not born in the USA.
- my Czech birth certificate has a different last name on it that I use. My mother got remarried and changed my last name when I was little. Next to my birth certificate, I also have a paper which states the legal name change. Do I need to have that translate also and will that make me any problems?
- also I wanted to change my last name to my husband's name but it would be so confusing for USCIS since my passport and all the documents needed are in my last name. When is the best time to change the name?
- and one last question. When I'm done with all the paperwork, do I go to our local USCIS with the papers or do I mail them?
