    Hello,

    I have a problem which I don't know how to solve and just wanted to see if anyone has had same problem?

    I am filing for I-130 and I-485, .... as a wife of US citizen. I overstayed my I-94. My passport is expired so I applied for a new one here at my country's consulate - because as I believe, to file I need a current passport. I am going to pick up my new passport on Friday but in order to get it, I have to surrend my old passport which has my visa in it. And here I am thinking that I will need the visa for the immigration. But I also need to have unexpired passport.

    What do I do? Anybody knows?
    Thanks a lot for any help.

      Tell your embassy you "lost" your old passport and do not surrender it
