I'm a first time user, so please excuse me if this is in the wrong section of the forum. Here is a (somewhat) short explanation of my situation:
I'm a U.S. citizen (born and raised in FL to U.S. citizens). My fiance and I have dated off and on for 9 years now. He is from Costa Rica and overstayed a visa. When he tried to re-enter the U.S. to attend college (which he had already paid for in NY), he was denied entry. He then stupidly (please no derogatory remarks on the next statement- we both already know that it was a very, very stupid and wrong decision) tried to enter illegally through the Mexican border. Of course he was caught and given a 10 year ban. That was 4 years ago.
Since then, he has obtained work/ school visas to Canada (one to Toronto and one to Montreal). He followed the rules to the "t" for each visa and is currently in Costa Rica with plans to return legally again to Toronto to finish college.
Here is my main question: if we were to get married and I were to file for an I-130, what are the chances of it being granted for his re-entry before the remaining 6 years of his ban?? I know it's a sticky situation but I will have obtained my degree in 2 years and would like to start a family. We also know that an immigration lawyer is necessary, but I'm wary of where to go for one because of all of the scammers out there. I would really prefer for us to live in the U.S. because I am very close to my family and have a grandfather battling Lymphoma (my other grandfather died of Leukemia in Jan. 2008), so moving to Canada or Costa Rica is most undisireable *sp to me. Is there any hope for us???
