  • A critical situation.

    Hi,
I came to US as international student . Due to the dictatorship that was reigning in my country, i did apply for asylum that unfortunally had been denied. I got married to a US citizen and got my 2 years green card.actually my dad passed away. Please, I just want to know if i can go home and come back without any issue? The political climat is better now since the president died.

Sorry to hear about the loss in the family. If your GC was not obtained proving that going to your country would put you in harms way, it may not impact anything.

I guess your GC was as a result of marriage to USC, so it should not be a problem if you visit now for the funeral. You may get questioned upon the authenticity of your asylum petition during your naturalization process and you have a good reason for the visit and the change in political situation now allowing you to visit.

This is my take on it and I am not a legal professional.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

No issues if you return to US with a valid green card.
