AOS or Consular Processing - Please help

Hello,

Couple of year’s back I became US citizen. My parents are planning to visit me over here in USA. They have 10 years of multiple entry visitor visas. I am keen in sponsoring them green card. I have following questions -

1. If they enter in USA on visitor visa and then if I sponsor for green card, will there be any issue because when they entered USA, their intent was to stay here temporarily and now the intent has changed and they filed for GC.
2. Are there any cases where parents came to USA on visitor visa and filed for GC and case got rejected on account of change in intent to stay here permanently?
3. Is it advisable to go with consular processing rather than AOS

There is always a risk with AOS from a visitor visa. A lot of cases get approved, but I have a heard some cases being denied or grilled at interview about their intent.

It is safest to go through CP.

I think it is not worth taking a risk for such an important issue.
Parents should go for CP. It is the safest. Takes about the same time these days.


90 days works fine in cases of people on a visitor visa marrying USCs
but ,not having an intent to immigrate is hard to prove for parents.
Expect intensive grilling at interview.

CP = Consular Processing

Means the application is processed in your home country and that's where you give the interview and get the final approval or rejection.
