  • I- 130 - Birth Certificate of parents - please help

    Last month I became US citizen and now I am preparing for my parents green card. I am preparing for I-130 application for my parents.

    My parents were born in small village in India. The village Nagarpalika (Government office which issues birth certificate over there) has no record of either of my parent’s birth.

    Government office over there gave a hand written certificate in Gujarathi language on just a piece of paper - not on letter head saying there is no birth record for so and so person in our files. Below that the officer has signed and put a seal of his office. The seal looks like

    Tahasildar,
    “xyz office”, Village Name.

    It does not even look like official government document.

    People over there are saying that’s all they can give. They do not have any official document or letter head which they can issue. Believe me it is really a small village and based on situation described by my parents I do not think that office can give any further document.

    My question is will immigration office accept this kind of letter? With situation described above, I am really confused and not sure what to do? Any help from anybody is really appreciated.

    US embassy/consulates in India are used to dealing with such issues related to bcs.
    In addition to whatever slip they gave you( you must submit it even if it does not look like a govt document)
    It will help if your parents can attach an explanation that this is what they got despite their best efforts.

    *An affidavit from a parent/relative/neighbour of each of your parent who saw the birth of each of your parent will be required.
    *And some secondary evidence of date of birth like a school leaving certificate/college diploma.

      I am planning to file for 130 and 485 simultaneously over here. Will it be an issue or you recommend I should do consular processing?

      *An affidavit from a parent/relative/neighbour of each of your parent who saw the birth of each of your parent will be required.

      My father is 78 years old and my mother is 75 years old. It is really hard to find some one who is older than 78 years old and may be an adult at the time of parents birth. Affidavit from some one at my father's age or may be 3/4 years younger than my father's age - is it acceptable?


      *And some secondary evidence of date of birth like a school leaving certificate/college diploma.

      I have several of such documents.

        In the olden times ...

        ... in many parts of India, there used to be a sect of people whose main job was to write down the happenings in the villages.

        These people wrote m****cripts with a lot of good data. They passed these "books" to their children and so on.

        If you can possibly get hold of someone who may have such a m****cript from your village you would be able to track down your parents' DOBs.

        This will be based on Hindu calendar which then needs to be converted into the appropriate Christian calendar date.

        Based on this you file an affidavit and this is then registered as the DOB of the person.

        This has been done a lot of times and is absolutely valid.

        If you cannot go through this route, then you need to figure something out.

        Speak with a senior attorney who can help you out.

          I recommended to you in another post that you should go with CP and not AOS. AOS carries some risk and at your parents' ages you should not take it.
          And with BC issues, CP is more advised because consular posts are used to handling such issues but officials in US may deny on the basis of bc issues.

          THERE IS AN OPTION FOR YOU WHICH WILL MAKE IT MUCH EASIER FOR YOU AND YOUR PARENTS;
          DIRECT CONSULAR FILING. TAKES ABOUT 3 MONTHS TO GET AN IMMIGRANT VISA FOR YOUR PARENTS

          You can visit India , file an I-130 with your parents direct at embassy in Delhi and return to US. Some relative in India can help your parents through the rest of the process which will take only 3 months.

          There is a rule that only USCs resident in India can file I-130s direct at the embassy but embassy defines exceptions for reasons of health and safety.
          Parents over 70 years included.
          This is the best option for you. Before starting for India write an email to US emassy new delhi to
          [email protected]
          stating that your are a US citizen (passport no.) wishing to file I-130 direct
          for your parents who are ...old(ages) and it will be hard for them to wait for regular CP.He would appreciate if the embassy will let him file direct without a residency requirement in India.
          Once you get a positive response from the embassy, you should go to India to file an I-130.
