    I am an U.S. citizen. I married a foreigner and applied a green card for her. But I divorced my wife in Feb 2008 before we had our first interview. I filed a divorce paper, I served her and submitted the service paper to the court. I supposed to file with the California court the final judgement to get the final divorce decreece. BUT I did NOT do it. Ideally, in August 2008 my divorce should be final if every thing ro be filed properly.

    The question is: Without the final divorce decreece, can my ex-wife able to obtain a new green card petition with her new marriage wiht another US citizen? (say, new marriage is no later than 2009)

    The reason I don't file the final divorce because she married me only for the green card, not love, and her next marriage could be the same, I don't want her to repeat the same move.
    And on my side, if I remarry after Aug 2008 (of course w/o submitting any more green card paper), am I committed bigamy in California?
    I appreciate your answer.

    No one can remarry (as per the law) without a final divorce decree signed by the judge. Until that judge signs on paper, both are still legally married.
