  • GC for my parents in India- Help

    Hello,
I have been granted a US citizenship very recently (last week) through a marriage to a US citizen. I want to file I130 petition for my parents who live in India.

I have a few questions about the application:
    1) Do I need a US passport for the I130 filing?

    2) Do I need to file I-864 (Affidavit of Support)

    3) If I have to file I-864, should I file it along with the I-130 application or should I mail it separately? And where to mail it, I live in Chicago.

    4) My parents do not have a marriage certificate, what are the alternatives?

    Your help is greatly appreciated.

    Thank you.

    Vijay

    1. No, your naturalization certificate is enough.
    2. Not now . Later at the embassy in India.

    3. Just file the I-130. You will also need to file your birth certificate showing your parents' correct names on it. This is to establish the petitioner-beneficiary relationship.

4.They can attempt to register their marriage or provide an affidavit. This will be required for processing at the embassy.

MARRIAGE CERTIFICATE: Any applicant who has ever been married must provide an original and a clear photocopy of the marriage certificate(s) for all marriages. Persons who married before 1955 must attempt to register their marriage. Failing this, they must submit affidavits on appropriate stamp paper sworn before a First Class Magistrate indicating the names of the bride and groom, the date and place of the marriage ceremony. Persons married in 1955 and later must submit a marriage registration certificate. Certificates issued by the appropriate authorities are acceptable if they are legally valid in India. If any of these documents were issued in a local language, a notarized English translation is required in addition to the original. If you and your spouse are applying for visas, you should submit an original and two clear photocopies of each certificate.

meaning of attempting to register a marriage.

      i have a related question.
my mother is widowed. since her maiden name and current name are different, we have to show the marriage certificate to show such effect. But she doesn't have a marriage certificate. since my father is no more, I'm wondering if they will issue a marriage certificate.
      what do you suggest?
what does it mean by attempting to register? is it like getting a non-availability certificate? she is married in the year 1973.
      thanks.
