  • I-130 and I-212

    I got deported in december 2007 and i got ban for 10 yrs(illegal entry). My question is, my mother have a green card and can she apply for me with I-130 and if they approve it can i use I-212 for Permission to Reapply for Admission? Or is it going to be problem? Do i have to wait 10 yrs? or its ok to apply for it.

    I think you can be apply but i doubt it will be accepted. To get a ten year ban, you had to have really overstayed your visa. So, good luck. No harm in trying.

      You have to wait 10 years. Or file an I-602 waiver (which are VERY HARD to obtain).

        I think its better to wait until my mother get the citizenship and that will be in 3-4 yrs also in mean time i could be married so she can make papers for both of us. thanx for the help .

          you will still have to wait a total of 10 years to be completed.

            I recommend that you study in your own country and begin a new carrer there and forget about the US. Even if your mother files for you, or even if she becomes a US Citizen does not mean anything to you. Even if she applies for you; the 10 year ban still applies plus all the waiting period and when you get an interview in 15-20 years, it will be very unlikely that you will get approve for the visa based on the previous record.
