Question about I-864

  • Question about I-864

    Will there be a problem if my fiance has been penalized by the IRS for some unpaid taxes from long ago (about 10 years) when he files the I-864 for my adjustment of status. I don't know if he's filing his taxes but I do see his W2s. I asked him if he did and he said yes but I didn't see him do it since we are living together already. Now I'm scared that this will hamper the process and what can be done about it? Please help those of you who have an experience like mine. Thanks.

    Your best bet i think would be to ask him to contact IRS and have them send his transcripts. They will be needed for the I-864 anway. This will tell if he has or has not filed. If he has not filed. He can still correc it quickly. He needs to contact the IRS and find out what he needs to do. IF you haven't filed in a while, you can still file now, you will be penalized but i think that USCIS just wants to see that you have an agreement in place, i don't think you have to be completely paid off.
