  • Applying green card for mother

    Hi

My mother is visting the US and I am planning to apply for a GC while she is here.

    I have completed filling the folowing forms: I-130, I-485, I-131, I-864 and I-693.

    1. Should I fill any other forms?
    2. Do I send all the above forms in one single packet?
    3. Can I use Fedex to send it?

    Thank you

    1.- G-325a
2.- Separate bundles for each form, inside one envelope.
3.- Yes, send it all to the Chicago Lockbox.

When did your mom enter the USA?

      Hi

      1. When you say seperate bundles in one envelope should I just clip them seperately and put it in the envelope?

      2. Also, my mother entered US 5 months back. She has one more month of visitor's visa. Is it risky to apply when she is on visitor's visa.

      3. Also once she applies can she continue to stay until she gets a response?

      4. She has a 10 year visitior visa, If for some reason the GC gets rejected will her 10 year visa be affected?

      5. If she gets the GC, to retain her GC I believe she should stay in the US for 180 days an year. If she cannot come here for an year, can she reinstate her GC without much trouble?

      Sincerely appreciate your help

        2. Also, my mother entered US 5 months back. She has one more month of visitor's visa. Is it risky to apply when she is on visitor's visa. She should be fine by undergoing AOS after 5 months from entry.

        3. Also once she applies can she continue to stay until she gets a response? She can and she MUST stay until her GC is approved unless she also applies and receives an approved Advance Parole (i-131) beforehand.

        4. She has a 10 year visitior visa, If for some reason the GC gets rejected will her 10 year visa be affected? Once she has applied for a GC, she demonstrates immigrant intent, which is the basis of the visitor visa requirements NOT to have immigrant intent. So, if her GC is denied or she decides not to pursue it after having applied for it, it will be very hard for her to use a visitor visa.

        5. If she gets the GC, to retain her GC I believe she should stay in the US for 180 days an year. If she cannot come here for an year, can she reinstate her GC without much trouble? No. She must live here. Period... read here: https://www.immihelp.com/retain-greencard-useful-tips/
