  • I130 Questions

    My mother(US Citizen) is applying for my married sister who is in pakistan. My mother had also filed I130 for me when she was a Permenant Resident back in 2002 which was approved in 2005 but i got married in late 2005 which made that petitions invalid. Now my mother is a citizen so i've following questions.


    B 14: If you are a lawful permanent resident alien, complete the following:
    "Does she have put any info in here, since she is a citizen now."

    In section D:

    1. If separate petitions are also being submitted for other relatives, give names of each and relationship.
    "Do i've to put my info here which was applied back in 2002.

    2. Have you ever before filed a petition for this or any other alien?
    "Do i've to put my info here"

    Also what document should she submit for her daughter. Only birth certificate and her citizenship certificate?

    1. no. either fill 13 OR 14. not both. the instructions are clearly given on this page

    2. D-1 sounds like whoelse is currently filed.

    3. D-2 definetly your info.
    If I were you, I would call uscis to make sure.

    4. proof of relationship: at i 130 level, they ask for birthcertificate. But later or, I beleive during interview they ask for more evidence. Like in India, chennai U.S consulate, they ask for (besides birthcertificate) old passport, old ration card, property document etc.
    "For children (IR2, IR3, F1, F24, F3 and F4 visas) and Parents (IR5 visas) of the U.S. Citizens, children of Family Based Visa Applicants (F3 and F4 visas) and Children of Fiancé (e) visa applicants (K2 visas):

    Primary: Old Indian passports, birth registrations issued within one year of the birth

    Secondary: Secondary school leaving certificates, old ration cards, old baptismal certificates, old family documents such as land transfers and wills, original wedding invitations, college degree certificates, mark sheets, property certificates, family photos or other reliable documents which show the required relationship."

    you can check your concerned consulate to get complete figure.

      applying greencard

      hi

      i was read yr thred, I have same case. my mom and dad both are here and i am usa citizen, they was came here on visitor visa and i want to apply their greencard here, can i do that ? and if i can apply here, is this any risk on their greencard?

      after apply how many days they get greencard here?

        Yes you can, but there is a risk. Because they entered with the intention to visit, not to stay here permanently.

        Either way, it would take 5-8 months for them to receive their GCs.

          Applying parents greencard

          hi
          I am us citizen and my parents was came here on before 25 days ago on visitor visa. they have 10 years visitor visa. My question is i want apply my parents green card. I will be really confused what i will do? because some people says if you apply here is risky. and i don,t want to west time. if they go back India after six months and apply green card there and it's take 1 year there. my question is what is best advise on this case, please help me .... because i want their green card ASAP without west time. they are go back to India 20th Nov. Is this possible, untill they here, and i will put their file here but processing in india?
          when they go back to india they save atlis 4-5 months. or other way i will send all document to my brother in india and he is send to embassy in india. can i do that? Please give my replay ASAp

            i understand your parents are here already on a visitor visa. if this is correct, go ahead and file form i-130 ONLY and have them deal with the rest through consular processing back in their country of origin. DO NOT FILE I-485 to adjust status, unless you hire a good lawyer. doing it through consular processing is the safe way to go, you'll be saving money too.

              OK i will deside i want to submit just I-130 for my parent's, I have question , they are here then am i have to submit I-130 here in chicago or India ? Please thanks to give my replay early. please give me reply..
