  • Applying for Parents

I just became a US citizen through marriage and I want to apply for my parent's status and I have some questions: please help!

What forms exactly do I need to submit?

My parent's have been here on an expired visa since 92, how does that affect the process?

They have both worked illegally but with their real social sec # since 92. Should I put that in the applications? the jobs they have had? they have paid taxes every year.

They own a house here so I dont live with them, should I put their address or mine?

Please help me, I'm very confused. THanks in advance!

You need to submit I-130 and I-485 with I-131 (free) and I-765 (free) all together for both using the address they live at and send everything to the Chicago Lockbox. You need to look on uscis's website as to what paperwork you need to send etc. It's all very tedious if you do it yourself but it can be done. However if your parents have been here and working illegally I would suggest consulting an attorney first. I think you have to pay a penalty for being out of status.

Thank you for the help. I think the attorney might be the best idea. I don't want to make things worse for them if I make a mistake on the forms....

Good idea but you don't have to be a rocket scientist to fill out those forms. If you make a mistake you just get the paperwork back for correction. Of course it can slow things down but I am sure attorneys make mistakes too. First check with the attorney what the best course of action is when applying for your parents since they are out of status and working illegally. Good luck!!

          Petitioning for parents and brother

Can someone help me with this question or guide me in the right direction for the answer?

My friend just became a US citizen and wants to petition her parents to the United States, but she also has a little brother 16 years old.

She has to file seperate petitions for each parent. My question is does she also file a seperate petition for the brother or can he be included with one of the parent because he is a minor.

          Thank you

                That's ok ...

                ... you're a good person to admit a mistake.

                Good luck to you.
