  • I-130 form, can you stay in the US whilst it is pending?

    Hi everyone, I really need some help here. I came to the states Dec 06 on a tourist visa with no plans on staying. But I ended up staying and applying for a I-130 form through my parents, who are sponseing me. I was under the impression that this may take some time. I have recenlty been offered a paid job by the work I volunteer at, and they were willing to sponser me for a work visa. I then went to a immigration lawer and he said, I had over stayed my visa by a year. But I had been notifed by the USCIS offcie call center that I could stay in the states and wait for my alien number. Which is correct?
    What will happen when the UCIS get to my case?
    Will I be deported?
    Can I marry a US citzen or a LPR? and stay?
    I would so gratful if you could offer me adivce on any of these questions.
    If this helps I am over 21 unmarried and my father is a US Citzen. I have not done any work under the table. I am just very confused and of course worried.

    your story is some how confusing. but anyways, in my opinion, the best you can do is get it done through your parents. why get married (and take all the risks involved with marriage ) when you have a USC father???
