  • Please Help!!!!Urgent!!Birth Certificate

    I married to USA citizen in 2004 and I am USA citizen now. I want to file I-130 for my parents for their USA immigration. I mentioned my parents’ names, birthdates and birthplaces in the forms that I filled out for my immigration to USA from india in 2004. This info (my parents’ names, birthdates and birthplaces) I took from their school leaving certificates and they also applied for their Indian passports based in this info. Now here is the problem.

    I think they will need their birth certificates for their USA immigration but they don’t have their birth certificates. So they went to their municipalities for getting these and they found out that their names and birthdates are different (than other documents like school leaving certificates) in municipalities records. So they asked the municipalities to give the correct birth certificates but municipalities denied for doing any change. They also denied giving “No records of Birth Cerificate”

    I am confused here. Can anyone please advise me on how to proceed for I-130 and USA immigration for my parents? Does anyone came across same problem or know how to solve the problem. Is there any other alternative to get “No records of Birth Cerificate”? Can they immigrate without birth certificates and “No records of Birth Cerificate” Please Help.

    See if there is a Legal option in India..

    You can prove with all supporting documents that it was an error and see if you have a legal option to get a court order to change the birth/death facts.

    I know that if they lost your records you can have it entered.. after public display of your records, advertising etc, if no one objects --- I would wonder who would even care to object.

    Get in touch with a lawyer in India...

    There is no way around this, US Immigration expects that your records are in order, if they are not then its upto you to correct it. So find a way and do this so that something like this does not come to bite you 10 years later that invalidates your green card.

      I have the same exact problem with my mother's birth certificate. I just can't believe how it's the exact situation!! What did you do about it?? PLEASE HELP ME!! I don't know what to do!!

        U can have an affidavit made from the public notary by any of yours relatives of your mother viz brother, sister ( older ones) that the records of birth certificates are not available and her date of birth is....................... this u can submit! and alongwith it attach ur mother's OLD passport photocopy or ration card or school leaving certificate or any other old documentary proof of her age same as u have shown in records now!

            I have same issue.

            I have applied for my father I-130 & I-485 from here in US. After applying, when we searched for the birth record in India, we found that DOB is one week later than what he was using through out the life. For example April 2nd in all document, in birth certificate it has April 9th. Application was mad with wrong DOB April 2nd.

            Is there any solution to correct the problem to get corrected DOB in the application? Is it possible that my father can affidavit for him self that he had wrong DBO from his school leaving certificate as well as from his late father's affidavit and he found his birth certificate has correct DOB. or some other way?
