  • Need clarification on form I-864

    My wife intends to file for me but I figured that her individual income will not meet the income requisite inorder to sponsor. However, both of of us filed a joint income tax return for 2007. As the intending immigrant I would like to list my assets( which I'm not sure whether it is acceptable to do) on the form. My problem is that I cannot find a specific part of the form to do so. Must I include an explanation page for the assets and attach it to the form?

    I-864 Line 24 (b)

    You will have to fill out your income on line 24 (b) but remember you will have to prove that this income will continue to flow from the same source after you become a LPR. You do not have to file I-864A form since your wife is sponsoring you.

      Proof of income

      I've continued to be employed with my employer dating six years ago. Does this count as proof that my income will continue to come from same source? I'm not on salary basically, but I'm unsure whether a stable job history like this will suffice to clarify any doubts of future income.

        Your continued employment with the same employer does help but you will have to produce a "Letter of Employment" from your employer stating that you have been working with them for the past 6 years and what is your contracted salary/compensation; your past 6 months worth of paystubs, last 3 years worth of tax returns, bank balances etc. If you are confused, please consult a knowledgeable attorney in this matter.

          Proof of employment

          Thanks for your insight Spra. I still have another question though.

          I managed to get a letter of proof of employment dated back in February(we were going to file the papers then; that's when I got it but some unforeseen events stalled our filing) and I've saved all my pay stubs since then. Along with the proof of employment, my job attached photocopies of my previous 6 months stubs prior to February. My question is, since I continue to work with the same employer and I will be sending out all my packages in a few days, would it be alright to send that proof of employment, though it's 6 months old, along with all my pay stubs dating back from February? Or just get an updated copy of the proof of employment letter?

            Normally, employment letter is valid for 6 months - however, I would get a latest one! Good luck.
