I am currently on H1-B visa and my H1-B will be up for renewal in 11/09. My wife had filed a petition for my permanent residency and the priority date for that application was January 2004. NVC is currently processing October 2003 cases (Category F2A).
My wife also applied for her citizenship back in May 2006. Unfortunately her case got stuck in the FBI Name Check process. Just a few days ago, we received a letter from USCIS for re-taking the fingerprints which hopefully indicates that her N-400 application might now start moving.
Here is my dilemma:
1. As far as my green-card petition is concerned, should I go for consular processing or adjustment of status? I am already in USA on H1B visa. NVC started sending communications to me a few months ago and now I have to send a $400 check if I want to opt for consular processing. Which is better?
2. If I opt for Adjustment of Status instead, I have to write a letter to NVC and inform them of that decision. However, how would USCIS know that I am opting for adjustment of stauts instead?
3. For Adjustment of Status, if I file I-485 and I-765, how soon can I get a work-permit to work wherever I want?
4. For consular processing, what exactly is the process? Let's say, I send the $400 fees and in 2 months my priority date becomes current. Would I get a letter from NVC saying that I now need to go to India. What happens in India? How long does the process take? Do I enter USA with a green-card now?
