    I'm married to US citizen and have been working on H1B since early 2006.My wife used to work for about a year plus before marriage.After moving in with me she is no longer working.

    She is planning to file for family based immigration. However i've been reading that she needs to file
    Affidavit of Support (Form 1-864) as part of the process. Does she need to do this as i'm able to support both her
    & myself. Also we've been having a joint bank a/c since the last 1 year.

    In addition to the above, Please do let me know what all forms we need to file for GC since i'm already on H1B

    I believe she can but she will have to have a co-sponsor to help with the affidavit of support. Good luck

      Thank you for the response. I understand that she could jointly file affidavit of support i864 (say with her dad). Please let me if this would work.

      1. Also let me know if she would need to submit any of her past w2 or tax file information.

        Yes, her Dad can file as a co-sponsor (separate i-864) to sponsor you. as long as her Dad is also a US citizen or green card holder.

        I think you can also co-sponsor yourself if you have income in USA and documents to prove that, such as W2 and tax returns.

        but first option is let her Dad co-sponsor because that less hassle.


        Forms you need to file: I-130, I-485, G325(one for each of you)

        Form 1-864 with 3-years of tax returns, recent bank statements, bank letter and employement letter, etc.

        if her dad is co-sponsoring then he also need all of those supporting financial documents along with his citizenship or green card proof.

        along with all supporting documents to support your genuine marriage.

        one more form of I-693 medical examination

        all the forms and documents goes in one package to I-485 mailing address.
