  • Overstay I-94(B2) after filing I-130 -Family based GC

    Please help us...

    I'm a US citizen. Couple of times my mother visited US on B1/B2. My mother is in US now on B2 and her I-94 will expire next month. I'm planning to file GC for her. Can she stay (legally) past I-94 after applying I-130?. Or the I-130 must be approved before expire of I-94 ?.
    I'm planning to file I-130, I-485,I-131,I-765,I-864 & g-325 all at once.

    She can stay for as long as she files I-485. The I-130 by itself does not give you any legal status.

    How long ago did she enter the USA?

      Thanks PraetorianXI. She entered US 5 months ago. By mid October her I-94 expires. I'm planning to file at least I-130, I-485,I-131,I-864 & g-325 next week.

          I am in the same boat. We need I-130 and I-485 and Advance parole only correct. What are the other forms you are mentioning.
