  • employment authorization card

    Hello,
I am married to a US citizen and currently reside in the US. I am here on an F-1 visa which expires in 2012 which is also the year of my expected graduation.
I was wondering if I can apply for an employment authorization card without having to apply for adjustment of status. If that is a possibility, does my wife still need to file an I-130? We have been married for 3 months.

    Thank you!

      EA card

No, as in I cannot apply for an employment authorization card or no, my wife does not have to file I-130? I didn't quite understand your answer.
      Thank you for your help!

You can not get an EAD without having an I-485 properly filed and pending.

Your wife has to file I-130 and you must file I-485, then you are allowed to apply for I-765 (your EAD).
