My interview is scheduled on 10/1. My parents' visas will expire on 10/23 and
they originally plan to leave the U.S. on 10/11. I plan to submit green card
applications (I-130 / I-485)for my parents at the same day when I take the oath.
I have a couple of questions:
Shall I apply for visas extension for my parents now? My laywer recommended not. However, I was told there will be $1,000 fine for applicant who extends their stay without applying for extension. If USCIS denies the visa extension application, will it have any adverse effect on greed card application in the future?
I also read from this website that there will be 60 days grace period after visa expires. If I don't submit the extension application (I-539), when will my parents' status be considered legal, as soon as I submit their applications or after I receive I-485 receipt (if that happens before the grace period expires)?
