  • visiting US while sponsorship app is pending

F-1, H-1, GC, Citizenship... I thought I would be done with INS by now, but apparently not. Well, here's the story:

I recently received my citizenship. Now, I'm sponsoring my parents and brothers for green card. Parents' green card is relatively quick, but siblings' might take 12 years. Once I file application to sponsor them, it'll be difficult for them to get a visitor visa during those 12 years.

So I'm thinking they should get a visitor visa (B-2) first, and then I can file application to sponsor them. Hopefully they'll get a 10-year multiple entry visa and everything will be fine.

If they get a short-term visa then it's going to be a problem getting a visitor visa later (after sponsorship app is filed) a second time.

Also, their children are studying engg and they'll be coming to the US for further studies. So if my siblings do not have a visitor visa, during those 12 years, they will not be able to visit the US to meet their children, their sibling (me) and their parents (who, presumably, would have migrated here by that time).

    1. Any insight on this situation? Is there a better way to do things? Any experience shared here will be appreciated.

    2. Also, when their children apply for F-1 to student visa, what should they answer in the question:

Has anyone ever filed an immigrant visa petition on your behalf?

I ask because my understanding is that filing for a sibling means the whole family (i.e. spouse and minor children) are also eligible under that application, but by the time the application will be approved (after 12 years), their children will be major and not eligible.

So in other words, should they answer No to the above question? Or will it be considered an untruthful answer and they should say, Yes, but explain in the visa interview.

    Thanks for your comments!

No comments from anyone? I'm sure there are other people who are in the similar situation...
