  • When & how to file GC for parents?

    Hi,

    My husband and I got our Citizenship 10 days ago. I want to file immigrant visa & GC for my parents. After researching the internet, here are some questions that I have.

    What is the fastest way to bring them here? AOS or counslor processing? (I am visiting them this Dec, can I get Counslar processing done in Chennai Counslate?)

    Should I file I-130 & 1-485 together?

    When can they first come here if I file them together ? When can they first come here if I file them seperately?

    How long should they stay here before they can travel back to India if I file both I-130 7 I-485 together? What about the same if I file them seperately? (in either case, it should not impact the GC process like re setting the date)

    Finally, is it easier to hire a lawyer to do all this?

    You should submit there I-130.........

    you should submit there I-130 Petition..........this is the fastest way .........because you are U.S Citizen..... other wise your parents apply vist visa.....after they come U.S.... then you submit there petition.

      GC information

      If right now they are in India, best is applay CP. It is right and safe way to applay. once they apply their GC their and come here on B2 it's fine.

        Thank you sunny. Can anyone please tell me what are the travel restrictions after the I-130 is approved and VISA # is provided? From reading in the net, once VISA # is provided (which happens for parents as soon as I-130 is approved) they need to go thru medical exam and take other documentation and medical report and go to counslate. What does the conuslate do at that time? Do they STAMP IMMIGRANT VISA in parent's passport? After this VISA is stamped can parents travel to US? and when can they travel back to india....? Any clarity on these steps is greatly appreciated. Thank you ver much in advance for responding.

          I-130 petition for father and mother its takes 6 months atleast to approved.....then USCIS send the papers to you and your petitioner home.....1st submit visa fees......after visa fees submit dio data part 1 or 2..............total process for IR parents takes 2 years.

                Parents getting a GC are expected to live and pay taxes in the US. They may make short trips to their old home country but living there violates the terms of their GC.

                Your question makes it sound like they plan to use the GC as a substitute for a visitor visa; that is not appropriate.

                They should wind up their affairs before moving and LIVE in the US. If they intend to make India their home, do NOT file for their GC.

                  Thank you C4us for the response. My younger brother is still a tie to them as he lives in India and he is yet to be married. My parents intent is to live with me here but be able to travel back periodically for a month or 2 as necessary. I know that once their GC is approved they need to be here at least 6 montha an year to retain status and that they will still have the flexibility to make periodic trips as a GC holder. But I am concerned about the intermediate period....after their immigrant visa is stamped in Chennai and before I apply for GC/GC gets approved.
                  After their immigrant VISA is stamped can they come to US? If yes how long can they stay here before I file GC? When can they go to India after I file GC and it is still in process? Or can they just be on immigrant visa (without any GC in process) and make periodic trips.....

                  I know I am wordy here but like to know what the options are. Thanks for your patience and responses.
