  • Petition single daughter over 21 who is here in US

    Hi,
    My sister is here in the US for a visit.
    She is over 21 and is single. MY parents got their green card last December 2007. Is it possible for my parents to petition her while she is here in the US? If yes, how will that affect her current visitor visa and her I-94?

    If not, do you have an idea how long it usually take to petition a single child over 21 years of age?

    Yes your parents submit there petition.....

    Your parents submit there petition I-130......its total adjustment of case status.if she came on vist visa or eles visa category.

        Hi PraetorianXI,

        So does that mean my parents cannot apply petition while my sister is here in the US? Basically i want to understand

        1. whether her being here in the US will prevent my parents from turning in the application
        2. is she required to give up her tourist visa while the application is in progress
        3. what is the effect to her I-94 if the application is applied while she is here?

          Check the USCIS website for processing times. She cannot obtain a valid status for as long as it takes for her to get a visa number. It would be faster to get an employer sponsored GC.

          She cannot lie to VOs; she will have immigrant intent and may be denied entry and likely would be denied a new B2 visa. She can complete her current visit without problems.
