Issue with a birth certificate after applying for parents Green Card

  • Issue with a birth certificate after applying for parents Green Card

    I got my cititizenship and had applied for my parents Green card on March 2008 in Vermont
    In Sept 2008, I got a letter that my parents' files have been transfered to CA for faster processing

    After few weeks, I got an approval letter for I-130 for my father
    But I got a form I-797E (Request for Evidence) for I-130 for my mother saying I have not submitted the original birth certificate.

    I got my birth certificate from India but my name was not recorded in the records and so I got the affidavit indicating my name is added later.
    It worked in case of my father's I-130 but I got query for my mother's I-130

    There is one more issue. Name of my mother is not exactly mathcing in birht certificate and on form I-130 (typical indian name mistakes ..)

    I have mentioned all different names used in the form I-130 and also planning to get an affidavit from India indicating both names are for same person.

    Please help if you know what else I can do to resolve this request for evidence.

    I also have simillar problem..In Sibling's birth certificate father name has ended with "bhai"..

      Name missing on Birth Certificate

      Hi, I am applying for parents, but my name is not recorded when my BC was issued. I have my martic certificate which shows the DOB and father's name. Do I need to include some other evidence also? Should I file and see if they ask for another RFE or include some other evidences before filing? Any help is greatly appreciated. Thanks,

        Hi Denshah, I am also in same boat you were. My name is also not recorded on my BC and now I am applying for my parents. What else do I need to include with the application (I-130)? Thanks,

            Many of you have posted the questions? Could you please post the resolution? How did you solve this issue?

            I am in the same boat...

            I am yet to file.. I have a non availability certifiate of my mom's Birth Certificate but she has been a homemaker for last 50+ years and do not have other docs... can Passport be given as secondary evidence? Which is what I have.


            I have already looked at the general guidance provided here in the immihelp.


            Please advise...
