Can my wife Use her B1 visa to come back after marrige?

Hello All,

I got my GC recently and iam not married yet .
Right now my fiance is here in US for 3 months on B1 visa.

I know i cant do anything to bring my wife here at this stage, but i wanted to know whether she can use her B1 visa to come back to US with me?
She got her visa till 2018.
And what if she quit her company in india after getting married, would she still be able to use the same visa to come here? or she needs any other documents from her company to step into US. Please suggest.

If there is a chance for her to come on same visa she has now , that would be a great relive for us.

She should not do that. She can come on other visas like H1b/L1 for longer stays. She has to maintain her own status in US while married to you and you can get started on her family based petition after your marriage. It will take a long time.

I know if she come here on B1 she can only stay upto 3 months. Thats OK.
Anyway iam going to apply for H1B for her in next kota. But meanwhile can she use the visa (B1)which she already have to come here. If yes,what are the risks involved in doing that ?

If the immigration officer at POE suspects that she is married and questions her, she cannot lie. If she does answer the truth, there is a greater chance for denied entry as you are a permanent resident and she has greater ties to you and would likely overstay.

B1 is for business purpose and the business need does not exist here. You are complicating the whole thing and risking it.

YOU cannot apply for her. She needs to find her own employer and have him file a petition.

A B1 visa is to do business for her offshore employer. She likely has a B1/B2 which would allow her to enter as a tourist. She risks being denied entry due to marriage to a GC holder.
