I am a US citizen by birth. My non US parents were studying in the USA in 1960's before we moved back to our home country when i was a little child.
I have lived all my life outside the USA and now i am planning to move back to the USA. I am married to a non-US wife since 1994 and we have 3 children 12,7 and 5 yr old.
I was told by the US embassy where i live they can not be US citizens according to the latest Feb,2001 law Because i did not live in the states for a minimum of 5 years 2 of which when i am over 14 years old).
I have searched the net and found that i should file a petition for my wife and kids then if it is approved they can be issued an immigrants visa to enter the states as a legal permanent residents.
1- I would like to know is there another way for my children and wife be US citizens?
2- If i need to file a petition for them, will my kids be eligible for US citizenship immediately after they arrive to the USA regardless of the number of years they have to reside in the USA like my wife?
3- Do i only need to file form I-30 and G-325A for the petition or there are other forms to fill in?
4- Can i do the petition myself and what are the chances to get approval?
5- Is it true that it is better to be handled by an immigration lawyer for better representation and higher chance of petition approval?
